By downloading, installing, or using the Mystoria mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Mystoria is a mobile application that helps parents, caregivers, and educators create personalized social stories for autistic children. The App uses large language models (LLMs) to assist in generating story content based on user input.
Mystoria is an educational and supportive tool and is not a substitute for professional medical, therapeutic, or clinical advice. Always consult qualified healthcare providers for diagnosis and treatment decisions.
3. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the App.
- The App is designed for both adults and children. Children are encouraged to use the App together with a parent or caregiver.
- By creating an account, you represent that you have the legal authority to agree to these Terms.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You agree to notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree to use the App only for its intended purpose and not to:
- Use the App to generate inappropriate, harmful, or abusive content.
- Attempt to reverse-engineer, decompile, or extract source code from the App.
- Use the App to collect personal information about others without their consent.
- Interfere with or disrupt the App's functionality or infrastructure.
- Use automated systems or bots to access the App.
- Violate any applicable laws or regulations.
6. Content and Intellectual Property
Your Content
You retain ownership of the story content you create using the App, including text, customizations, and configurations. By using the App, you grant us a limited license to process your content solely for the purpose of providing the service.
Our Content
The App, including its design, code, graphics, interface, and documentation, is owned by Mystoria and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our written permission.
LLM-Generated Content
Stories generated using the LLM features are created based on your input. While you may use and share these stories for personal and educational purposes, you acknowledge that LLM-generated content may not always be accurate, complete, or appropriate. You are responsible for reviewing all content before sharing it with children.
7. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement.
- That the App will be uninterrupted, error-free, or secure.
- That LLM-generated content will be accurate, complete, or suitable for any specific child or situation.
Mystoria is not a medical device and has not been evaluated by the FDA or any medical authority. The social stories created with the App are for educational and supportive purposes only.
9. Limitation of Liability
To the maximum extent permitted by law, Mystoria and its creators, affiliates, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use or inability to use the App.
- Any content generated by or through the App.
- Unauthorized access to or alteration of your data.
- Any third-party conduct or content on the App.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $50, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless Mystoria, its creators, and the University of Washington from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
11. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in King County, Washington.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
